1. Introduction
This Cancellation & Refund Policy (“Policy”) governs the cancellation of Membership Packages purchased through Elysium Management Company (“Elysium,” “Company,” “we,” “our,” or “us”).
By purchasing a Silver, Gold, or Platinum Membership Package, you agree to this Policy.
This Policy should be read together with:

Shareholder Agreement (where applicable)
2. Nature of Purchase
A Membership Package may include:
Access to lifestyle benefits across Elysium’s business sectors
Allocation of non-voting shares (subject to acceptance and compliance approval)
These two components are legally distinct.
3. Cooling-Off Period (Where Applicable by Law)
If required under applicable consumer protection laws:
Members may request cancellation within 7 calendar days (or longer where legally required in their jurisdiction) from the date of purchase, provided that:
No benefits have been materially used; AND
No shares have been issued; AND
No compliance processing has been completed.
Refunds during the cooling-off period may be subject to administrative processing fees.
If shares have already been issued, the equity component may not be refundable.
4. Cancellation Before Share Issuance
If a Member cancels before:
Completion of KYC/AML review
Issuance of shares
Activation of core membership services
The Company may, at its discretion, issue a partial or full refund minus:
Banking fees
Merchant processing fees
Administrative costs
5. Cancellation After Share Issuance
Once non-voting shares have been issued:
The equity portion of the Membership Package is non-refundable.
Shares are subject to a 4-year lock-up period.
Shares may not be redeemed by the Company unless otherwise provided in the Shareholder Agreement.
Membership cancellation does not automatically cancel share ownership.
Equity terms are governed exclusively by the Shareholder Agreement.
6. Cancellation After Membership Activation
Once membership benefits have been activated or accessed:
The membership fee is generally non-refundable.
Used or partially used benefits are not refundable.
Promotional, lifetime, or structured aviation benefits are non-reversible once activated.
7. Company-Initiated Cancellation
Elysium reserves the right to suspend or terminate membership if:
AML/KYC requirements are not satisfied
False information was provided
Sanctions screening produces a positive match
Fraudulent or unlawful activity is suspected
The Member breaches the Terms & Conditions
In such cases, refunds are at the sole discretion of the Company and may exclude the equity component.
8. Chargebacks & Payment Disputes
By purchasing a Membership Package, you agree:
Not to initiate unjustified chargebacks.
To contact Elysium first to resolve disputes.
If a chargeback is initiated after shares have been issued:
The Company reserves the right to suspend benefits.
Legal action may be taken to recover issued equity value.
Shareholder rights may be restricted pending resolution.
9. Processing Time for Refunds
Approved refunds (where applicable) may take:
7–21 business days
Subject to banking timelines (including FNB processing standards)
Merchant processing fees may not be refundable.
10. Jurisdictional Considerations
Because Elysium operates in:
United States
South Africa
Mexico
Philippines
Other international markets
Refund rights may vary based on applicable local consumer protection laws.
Where mandatory statutory rights apply, those rights will prevail over this Policy.
11. Non-Transferability
Cancelled memberships may not be transferred to third parties unless expressly authorized in writing by Elysium.
12. Amendments to Policy
Elysium reserves the right to modify this Cancellation & Refund Policy at any time.
Updated versions will be posted on the website with a revised effective date.
